Terms of Service

These Terms of Service ("Terms") govern your access to and use of shufflephase.com (the "Site"), operated by ShufflePhase ("ShufflePhase", "we", "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

You must be at least 13 years old (or the higher minimum age applicable in your jurisdiction) to use the Site.

The Site provides competitive trading card game coverage, including news, decklists, tournament results, calendar information, and related reference material.

ShufflePhase is unofficial. It is not affiliated with, endorsed, sponsored, or approved by the publishers, licensors, or rights holders of the games it covers.

The Site does not provide public user accounts, comments, uploads, forums, or other user-generated content features. You are responsible for how you use the publicly available information on the Site.

We try to keep information accurate and useful, but trading card game rules, tournament results, card databases, release dates, and metagame information can change or contain errors. The Site is provided for informational and editorial purposes only.

You should verify important tournament, event, rules, ban list, product, and pricing information with official sources before relying on it.

ShufflePhase owns or licenses the Site design, original editorial content, compilations, and related materials created for the Site, except for third-party materials.

Game names, card names, artwork, logos, trademarks, and related materials belong to their respective owners. They are used on the Site for the purposes of news reporting, commentary, criticism, identification, and reference, which we believe constitutes fair use and nominative use under applicable law.

We respect the intellectual property rights of others. If you believe content on the Site infringes your copyright, please send a written notice to admin@shufflephase.com including:

• identification of the copyrighted work you claim has been infringed;
• the URL or location on the Site of the allegedly infringing material;
• your contact information (name, address, email, telephone);
• a statement that you have a good-faith belief the use is not authorised by the rights holder, its agent, or the law;
• a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the rights holder or authorised to act on its behalf; and
• your physical or electronic signature.

You agree not to misuse the Site, interfere with its operation, attempt unauthorised access to non-public systems, scrape or crawl the Site in a way that burdens or disrupts the service, or use the Site for unlawful purposes.

We use third-party services for hosting, database, content delivery, search, and other site functions. The Site may also link to third-party websites and resources. We are not responsible for third-party content, policies, or practices.

The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Site will be uninterrupted, error-free, secure, or always up to date.

To the fullest extent permitted by law, ShufflePhase and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, use, goodwill, or profits arising out of or in connection with your use of the Site, even if advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In those cases, our liability is limited to the minimum extent permitted by applicable law.

You agree to indemnify and hold harmless ShufflePhase and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Site or your breach of these Terms.

We may suspend, restrict, or terminate your access to the Site at any time, without notice, if we believe you have breached these Terms or pose a risk to the Site or other users. We may also modify, suspend, or discontinue the Site (in whole or in part) at any time.

These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Texas, United States of America, without regard to its conflict-of-laws principles. The exclusive venue for any dispute is the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Site after changes are posted means you accept the updated Terms.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms in connection with a transfer of the Site or our operations.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ShufflePhase regarding the Site and supersede any prior agreements on the same subject matter.
